Sessions / Appointments Terms & Conditions Agreement
This agreement ("Agreement") is by and between the appointment purchaser and/or attendee ("You"), and Halo Auragraphic, Inc., ("Halo"), a California Corporation.
By purchasing any appointment and/or aura reading session ("Session(s)") with Halo, you are agreeing to the following terms and conditions.
1. YOUR RIGHTS
a. Personal Use - Halo grants you a limited personal use license ("Personal Use License") to use the aura photograph(s) ("Aura Photo(s)") derived from your Session(s) for any personal, private, non-commercial usage. The Aura Photo(s) may be used on your personal social media account(s).
b. Commercial Licensing - The Personal Use License does not extend to commercial use. Under the terms of this Agreement, you understand and agree that the Aura Photo(s) shall not be used for any commercial purposes, such as, but not limited to, business websites, advertisements, promotion, business media of any kind or in conjunction with marketing goods or services. If you would like to use the Aura Photo(s) for any commercial purpose, please contact us at info@haloauragraphic.com, to discuss commercial licensing.
2. HALO'S RIGHTS
Halo retains all rights, title, and interest in and to the intellectual property, including copyrights, associated with and derived from your Session(s), including, but not limited to, any Aura Photo(s) of You.
3. AURA PHOTO(S) RELEASE
You hereby grant Halo a royalty free, perpetual, worldwide, and irrevocable right and license to use the image and/or likeness of You appearing in the Aura Photo(s) derived from your Session(s) in all forms and manners of media, including but not limited to, advertising, marketing, publications, newsletters, social media, or any other lawful purposes ("Use"). You waive any right to notice of such Use, and to inspect or approve any Use. You release, discharge and agree to indemnify and hold harmless, Halo, from any claim or cause(s) of action, now known or later discovered, including invasion of privacy, right of publicity, and defamation, arising out of Use of the image and/or likeness of you appearing in the Aura Photo(s) derived from your Session(s).
4. ALL SALES FINAL
You agree that all sales for Session(s) are final and no refunds, credits or reschedules will be granted after booking is complete.
5. IN THE EVENT YOU CAN'T MAKE IT TO YOUR SESSION(S)
In the event you cannot make it to your aura photo Session(s), you are welcome to pay it forward and have a friend or loved one go in your place by forwarding them your order confirmation email. They will need to present your order confirmation email upon arrival to use your Session(s).
6. LATE ARRIVALS
If You are more than 5 minutes late to your scheduled Session(s), your Session(s) will automatically be forfeit without a refund, credit and/or the option to reschedule.
7. MISSED SESSIONS
You agree that refunds, reschedules and/or credits will not be granted in the event You miss your Session(s) for any reason.
8. SUBJECTS IN THE PHOTO
We can accommodate up to two (2) people maximum in the photo (Example: 2 adults or, 1 adult & 1 child over age 7). To have a Buddy in the photo with you there is a $10 add on fee that must be selected and paid for during the booking process. If you miss this or forgot to add this, contact us and we will be happy to add it to your Session(s).
9. ONE COPY OF PHOTO
Only one film copy of the Aura Photo(s) will be received per booked Session, even if you selected the option to have a buddy in the photo with you.
10. CHILDREN
You agree and understand that Children under the age of 7 are not permitted to participate in the Session(s) due to the delicate equipment involved, safety, and the 10 second long exposure which requires the subject to hold very still.
11. PETS AND/OR ANIMALS
You agree that pets and/or animals of any kind are not permitted to participate in the Session(s). Only legally designated service animals will be permitted.
12. RE-DO'S
You agree since all aura readings are shot on analog film, re-do's will not be given.
